1. Acceptance of Terms

By accessing and using EnDocs AI (the "Service"), a website and service provided by Creative Encode Technologies Pvt. Ltd. ("Company", "we", "us", or "our"), you ("User" or "you") agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our website or services.

2. Eligibility

You must be at least the age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding contract.

3. Description of Service

EnDocs AI is an online AI-powered document workspace that provides tools for viewing, editing, merging, splitting, compressing, and converting PDF files, as well as AI chat assistance.

4. Guest Sessions and Accounts

Currently, the Service operates primarily via temporary "Guest Sessions" without requiring user registration for basic usage. You are responsible for maintaining the confidentiality of any session links or identifiers provided to you, and you accept responsibility for all activities that occur under your session.

5. User Content and Ownership

Your Content: You retain all ownership and intellectual property rights to the documents, text, and files you upload to the Service ("User Content"). We claim no ownership over your files.

Your Responsibilities: You represent and warrant that you have all necessary rights, permissions, licenses, and authorizations to upload and process the User Content on our Service.

6. Permission to Process User Content

By uploading User Content, you grant us a temporary, worldwide, royalty-free license to use, host, reproduce, and process the User Content solely for the purpose of providing the Service to you (e.g., converting a PDF to Word, compressing a file, or summarizing its contents).

7. File Processing and Automatic Deletion

Data Privacy Architecture: Our AI assistant orchestrates tool usage by primarily receiving metadata (e.g., page counts, file sizes). However, our document-processing services necessarily access file contents to perform requested operations (e.g., text extraction, PDF-to-Word conversion).

Deletion: We are designed to automatically delete uploaded files from active service storage within approximately 60 minutes after processing or session expiration, subject to technical limitations, security backups, and legal requirements. 8. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which details exactly what data we collect (such as IP addresses, metadata, and analytics), why we collect it, how long we retain it, and with whom it is shared. By using the Service, you acknowledge and agree to the terms of our Privacy Policy.

9. Prohibited Activities

You agree to use EnDocs AI only for lawful purposes. You are strictly prohibited from using the Service for:

• Fraud, deception, or impersonation.
• Unlawful surveillance or infringement of intellectual property or privacy rights.
• Uploading malicious code, viruses, spyware, or malware.
• Attempting to bypass limits, circumvent security, or abuse our APIs and endpoints.
• Unauthorized access or attempting to reverse engineer the platform.
• Excessive automated usage, including utilizing bots or scraping tools without written permission.
• Uploading content that is highly offensive, illegal, or defamatory.

10. Intellectual Property

All software, design, text, branding, graphics, and underlying technology of the Service are the exclusive intellectual property of Creative Encode Technologies Pvt. Ltd. and are protected by copyright, trademark, and other intellectual property laws.

11. Third-Party Services

The Service may utilize third-party services, including but not limited to cloud hosting providers, AI model providers, analytics tools, and security services. Your interaction with the Service may result in data being processed by these third parties. We are not responsible for the availability or accuracy of third-party services.

12. Service Availability and Changes

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service.

13. Suspension and Termination

We reserve the right to suspend or terminate your access to the Service at our sole discretion, without notice, for conduct that we believe violates these Terms of Service, abuses our infrastructure, or is harmful to other users, us, or third parties, or for any other reason.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL CREATIVE ENCODE TECHNOLOGIES PVT. LTD., ITS DIRECTORS, EMPLOYEES, OR AGENTS, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

16. Indemnification

You agree to defend, indemnify, and hold harmless Creative Encode Technologies Pvt. Ltd. and its affiliates, and their respective officers, directors, employees, and agents, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms of Service.

17. Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes, claims, or controversies arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in New Delhi, India.

18. General Provisions

Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

Entire Agreement / Waiver: These Terms constitute the entire agreement between you and us regarding the Service. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right to modify or replace these Terms of Service at any time. Changes will be effective immediately upon posting to this page with an updated "Effective Date". Your continued use of the service following the posting of any changes constitutes acceptance of those changes.
